AGM Performance LLC ("AGM Performance," "AGM," "we," "us," or "our") sells automotive replacement parts, performance products, accessories, fluids, electronics, and related products for a wide variety of vehicles and applications.

This Product Information & Disclaimer explains important considerations concerning product information, fitment, installation, vehicle modification, performance claims, photographs, specifications, and use of products purchased from AGM.

This Disclaimer supplements AGM's Terms & Conditions and other applicable policies.

1. PRODUCT INFORMATION

AGM makes reasonable efforts to provide accurate and current product information.

Product descriptions, specifications, dimensions, applications, compatibility information, technical information, photographs, diagrams, performance information, installation information, and other product data may originate from product manufacturers or other sources AGM reasonably believes to be reliable.

Automotive manufacturers and product manufacturers may change specifications, designs, materials, packaging, applications, part numbers, software, calibrations, instructions, or other product characteristics without prior notice.

AGM may correct or update product information when inaccuracies or changes are identified.

2. ERRORS AND OMISSIONS

AGM does not intend to publish inaccurate or misleading product information.

However, typographical errors, data errors, incorrect specifications, pricing errors, image errors, application errors, incomplete information, or other inadvertent errors may occasionally occur.

AGM reserves the right to correct errors and, where reasonably necessary, cancel or modify an unfulfilled order affected by a material error.

If AGM cancels paid merchandise before fulfillment because of an error, AGM will provide any refund required by applicable law.

Nothing in this section limits a customer's rights when AGM supplies an incorrect product or materially misdescribes merchandise.

3. PRODUCT IMAGES

Product photographs and illustrations are provided to assist customers in identifying and evaluating products.

Images may occasionally be representative rather than depicting every exact variation, finish, revision, included component, package design, or vehicle application.

Differences may occur because of manufacturer revisions, production changes, updated packaging, photography, lighting, screen settings, or other factors.

Customers should rely upon the applicable manufacturer, part number, description, specifications, and fitment information in addition to photographs when selecting a product.

If an exact appearance, finish, configuration, or included component is material to a purchasing decision, customers should contact AGM before ordering.

4. VEHICLE FITMENT

Automotive fitment can depend upon more than a vehicle's year, make, and model.

Fitment may also depend upon factors including:

• engine;
• transmission;
• drivetrain;
• trim level;
• production date;
• chassis;
• wheel size;
• brake package;
• suspension configuration;
• factory options;
• emissions configuration;
• existing modifications;
• regional specification; and
• other vehicle-specific characteristics.

Customers are responsible for providing accurate vehicle information and reasonably verifying that the selected product is appropriate for the intended application.

AGM may provide fitment assistance, but customers should disclose relevant vehicle modifications and application information when requesting assistance.

5. FITMENT TOOLS AND VEHICLE SELECTORS

Any vehicle selector, fitment filter, search function, compatibility database, or similar tool provided through AGM's Website is intended to assist product selection.

Such tools should not be treated as a substitute for reviewing the complete product description, manufacturer requirements, part number, notes, exclusions, and application-specific information.

Where fitment information conflicts or appears unclear, customers should contact AGM before installation.

6. MODIFIED VEHICLES

Vehicle modifications may affect the fitment, compatibility, performance, or operation of other products.

A product designed for an otherwise stock vehicle may not fit or operate as intended when the vehicle has previously been modified.

Customers should consider existing modifications when selecting additional products.

AGM cannot reasonably anticipate every possible combination of aftermarket components installed on a vehicle.

7. UNIVERSAL AND CUSTOM-FIT PRODUCTS

Products described as "universal," "custom," "fabrication required," "modification required," or similar terminology may require cutting, drilling, welding, wiring, fabrication, programming, adaptation, additional hardware, or other work to complete installation.

"Universal" does not mean that a product will install on every vehicle without modification.

Customers should evaluate installation requirements before purchasing or modifying the product.

8. PROFESSIONAL INSTALLATION

Many automotive products require specialized tools, training, measurements, procedures, programming, calibration, tuning, or diagnostic equipment.

AGM recommends professional installation whenever appropriate for the product and application.

Installation instructions and manufacturer procedures should be followed.

A customer's decision to perform an installation personally does not change applicable manufacturer requirements or product specifications.

9. INSTALLATION RESPONSIBILITY

Improper installation can cause product failure, vehicle damage, personal injury, or other consequences.

Installers are responsible for performing installation using appropriate procedures, tools, specifications, and safety practices.

Customers and installers should inspect products before installation and should not knowingly install a product that appears materially damaged, incorrect, or unsuitable for the intended application.

If a customer believes AGM shipped an incorrect or damaged product, the customer should contact AGM before installation.

10. INSTALLATION IS NOT PROOF OF A DEFECT

The fact that a vehicle experiences a malfunction after installation of an aftermarket product does not by itself establish that the product caused the malfunction or is defective.

Diagnosis may require evaluation of:

• installation;
• vehicle condition;
• existing modifications;
• tuning or calibration;
• electrical systems;
• supporting components;
• maintenance history;
• operating conditions;
• fuel;
• fluids; and
• other relevant factors.

Warranty claims are handled under AGM's Warranty Information & Warranty Claims Policy and applicable manufacturer warranty terms.

11. PERFORMANCE CLAIMS AND ESTIMATES

Automotive performance results vary.

Any horsepower, torque, acceleration, fuel economy, temperature reduction, weight reduction, airflow, boost, sound level, handling, braking, or other performance figures appearing in product information may be based upon manufacturer testing, particular test vehicles, controlled conditions, estimates, or specific configurations.

Unless AGM expressly states otherwise in writing, such figures should not be interpreted as a guarantee that every customer or vehicle will achieve identical results.

Actual results may vary because of factors including:

• vehicle condition;
• engine condition;
• drivetrain;
• existing modifications;
• supporting modifications;
• calibration;
• tuning;
• fuel quality;
• environmental conditions;
• altitude;
• temperature;
• installation;
• maintenance; and
• testing methodology.

12. HORSEPOWER AND TORQUE

Where horsepower or torque gains are stated, customers should review the conditions and configuration associated with those figures when available.

Claims such as "up to," estimated gains, manufacturer-tested gains, or similar performance figures do not guarantee a minimum increase for every vehicle.

Differences between dynamometers, correction methods, environmental conditions, vehicle configurations, fuels, and testing procedures may produce different results.

13. SOUND

Descriptions of exhaust, intake, turbocharger, engine, or other vehicle sound are inherently subjective.

Terms such as "aggressive," "deep," "loud," "quiet," "moderate," "race-inspired," or similar descriptions are general characterizations and do not guarantee that every customer will perceive the sound identically.

Actual sound may vary depending upon the vehicle, engine, exhaust configuration, modifications, installation, operating conditions, and other factors.

14. COLOR, FINISH, AND APPEARANCE

Actual product color, texture, finish, weave, coating, machining, or appearance may vary slightly from photographs.

Variations may result from manufacturing processes, material characteristics, production batches, photography, lighting, or display settings.

Minor cosmetic variations that are normal for the applicable material or manufacturing process do not necessarily constitute a product defect.

15. MANUFACTURER CHANGES AND SUPERSEDED PARTS

Manufacturers may revise or supersede products without changing the fundamental application.

A manufacturer may replace an older part number with a newer part number, revise packaging, modify minor design details, or substitute updated components.

Where appropriate, AGM may fulfill an order with a manufacturer-authorized superseding part number that is represented as the current replacement for the ordered part.

AGM will not knowingly substitute a materially different product where doing so would materially change the customer's purchase without appropriate notice or authorization.

16. REQUIRED SUPPORTING COMPONENTS

Certain performance products require or strongly recommend additional supporting components.

Examples may include:

• tuning;
• fueling upgrades;
• cooling upgrades;
• upgraded fasteners;
• gaskets;
• sensors;
• wiring;
• drivetrain components;
• exhaust components;
• intake components;
• suspension components; or
• other supporting modifications.

Customers should review manufacturer recommendations and installation requirements before purchase and installation.

Failure to use required supporting components may affect performance, reliability, safety, or warranty coverage.

17. TUNING AND CALIBRATION

Some automotive performance products require tuning, programming, adaptation, calibration, or other electronic configuration.

Where required, the vehicle should not be operated outside manufacturer or qualified professional recommendations before appropriate configuration is completed.

Improper tuning or calibration may cause poor performance, warning lights, drivability problems, component damage, or other consequences.

18. VEHICLE MODIFICATION RISKS

Modifying a vehicle can change its original operating characteristics.

Depending upon the modification, changes may affect:

• horsepower and torque;
• acceleration;
• traction;
• handling;
• braking requirements;
• ride quality;
• noise;
• heat;
• engine load;
• transmission load;
• drivetrain load;
• suspension geometry;
• tire wear;
• fuel requirements;
• reliability;
• component life;
• emissions characteristics; and
• maintenance requirements.

Customers are responsible for operating and maintaining modified vehicles appropriately.

19. MOTORSPORTS AND HIGH-PERFORMANCE USE

Motorsports, racing, track use, competitive driving, and high-performance operation involve inherent risks.

Products subjected to competition or extreme operating conditions may experience greater wear, stress, heat, and service requirements than products used under ordinary conditions.

Customers participating in motorsports or high-performance driving are responsible for appropriate vehicle preparation, inspection, maintenance, safety equipment, and compliance with applicable rules and laws.

20. EMISSIONS AND REGULATORY COMPLIANCE

Some automotive products are subject to emissions, inspection, registration, equipment, or other regulatory requirements.

Customers must use products in accordance with applicable law and applicable product restrictions.

AGM's Emissions & Vehicle Compliance Policy contains additional information concerning street applications, competition and off-highway products, emissions-related modifications, and regulatory compliance.

A product's availability does not mean that it is lawful for every vehicle, application, configuration, or jurisdiction.

21. VEHICLE MANUFACTURER WARRANTIES

Aftermarket modifications may affect vehicle-manufacturer warranty claims depending upon the modification, alleged failure, warranty terms, and applicable law.

AGM does not guarantee whether a vehicle manufacturer or dealership will approve a particular warranty claim involving a modified vehicle.

Customers concerned about maintaining factory warranty coverage should review the applicable vehicle warranty before modification.

22. MANUFACTURER WARRANTIES

Products may be covered by warranties provided by their manufacturers.

Manufacturer warranty coverage, duration, exclusions, procedures, and remedies vary.

AGM's Warranty Information & Warranty Claims Policy provides additional information concerning warranty claims for products purchased from AGM.

Unless AGM expressly provides a separate written warranty, AGM does not create or expand a manufacturer's warranty.

23. THIRD-PARTY PRODUCTS AND BRANDS

AGM sells products manufactured by independent third parties.

References to manufacturers, brands, vehicle manufacturers, trademarks, vehicle names, model names, and part numbers are used for product identification, compatibility, informational, or authorized sales purposes as applicable.

Unless expressly stated otherwise, the sale of a third-party product does not mean that AGM manufactured that product.

Product design, manufacturing, instructions, specifications, and manufacturer warranty terms remain the responsibility of the applicable manufacturer, subject to AGM's own obligations under applicable law.

24. TECHNICAL AND CUSTOMER-SERVICE INFORMATION

AGM personnel may provide product information, general technical assistance, fitment assistance, or information based upon available product documentation and experience.

Such assistance does not eliminate the need for appropriate diagnosis, installation, tuning, inspection, or professional judgment for a particular vehicle.

Customers should provide complete and accurate vehicle information when requesting assistance.

AGM does not intend ordinary customer-service communications to constitute engineering, legal, regulatory, or vehicle-manufacturer advice.

25. CUSTOMER-PROVIDED INFORMATION

Customers are responsible for providing accurate information when asking AGM to identify, recommend, order, configure, or assist with a product.

Relevant information may include:

• vehicle year;
• make;
• model;
• trim;
• engine;
• transmission;
• drivetrain;
• VIN where appropriate;
• existing modifications;
• intended use; and
• other application-specific information.

AGM is not responsible for an incorrect recommendation resulting directly from materially inaccurate or incomplete information supplied by the customer, except to the extent applicable law provides otherwise.

26. SAFETY

Automotive repair and modification can involve serious hazards.

Customers and installers should use appropriate safety equipment, procedures, tools, lifting practices, torque specifications, electrical precautions, and manufacturer instructions.

A vehicle should not be operated when the customer or installer reasonably believes that a product, installation, or vehicle condition creates an unsafe condition.

Customers should obtain appropriate professional inspection or diagnosis where necessary.

27. LIMITATIONS

To the fullest extent permitted by applicable law, AGM does not guarantee that every product will produce a particular performance result, fit every modified vehicle configuration, satisfy every customer's subjective expectations, or be appropriate for uses outside its stated application.

Nothing in this Disclaimer excludes responsibility for AGM's own obligations concerning merchandise supplied by AGM or limits liability or customer remedies that cannot legally be excluded or limited.
