AGM Performance LLC ("AGM Performance," "AGM," "we," "us," or "our") is an automotive parts and performance-products retailer. Many products sold by AGM are manufactured by independent third-party manufacturers and may be covered by warranties provided by those manufacturers.

This Warranty Information & Warranty Claims Policy explains the general process for warranty claims involving products purchased from AGM.

1. MANUFACTURER WARRANTIES

Products sold by AGM may be covered by a manufacturer's warranty.

Warranty coverage, duration, exclusions, requirements, and available remedies vary by manufacturer and product.

The applicable manufacturer's warranty terms control the manufacturer's warranty coverage.

Unless AGM expressly provides a separate written warranty for a particular product, AGM does not create, extend, modify, or expand a manufacturer's warranty.

Customers may contact AGM before purchasing if they would like available manufacturer warranty information for a particular product.

Nothing in this Policy excludes or limits any warranty, remedy, or consumer right that cannot legally be excluded or limited.

2. WARRANTY CLAIMS ARE DIFFERENT FROM RETURNS

A warranty claim is not the same as a standard return.

AGM's Refunds, Returns & Exchanges Policy generally applies when a customer wishes to return eligible merchandise within the applicable return period.

A warranty claim generally concerns a product alleged to be defective, malfunctioning, or otherwise covered by an applicable manufacturer's warranty.

A product that is no longer eligible for a standard return may still qualify for manufacturer warranty coverage.

Likewise, the existence of a manufacturer warranty does not necessarily make a product eligible for a refund or return.

3. STARTING A WARRANTY CLAIM

To request warranty assistance for a product purchased from AGM, contact:

Please provide, where applicable:

  • AGM order number;
  • customer's name and contact information;
  • product name;
  • manufacturer;
  • part number;
  • vehicle year, make, model, trim, and engine;
  • VIN where reasonably necessary;
  • date of installation;
  • approximate mileage at installation;
  • current mileage;
  • description of the alleged problem;
  • photographs or videos;
  • diagnostic information;
  • fault codes;
  • data logs;
  • proof of professional installation where required; and
  • any other information reasonably requested by AGM or the manufacturer.

Providing complete information can help avoid unnecessary delays.

4. WARRANTY AUTHORIZATION

Contacting AGM about a suspected defect does not mean that the warranty claim has been approved.

AGM may need to submit the claim to the applicable manufacturer, distributor, or supplier for review.

The manufacturer may require:

  • photographs;
  • videos;
  • diagnostic testing;
  • data logs;
  • proof of purchase;
  • installation records;
  • maintenance records;
  • serial numbers;
  • product inspection;
  • return of the allegedly defective product; or
  • other information.

Warranty approval is subject to the applicable manufacturer's warranty terms and claim procedures.

5. DO NOT RETURN WARRANTY PRODUCTS WITHOUT AUTHORIZATION

Customers should not ship a product to AGM for warranty evaluation unless AGM has provided authorization or return instructions.

Unauthorized shipments may be refused or returned to the sender.

A return authorization, warranty authorization number, shipping label, or instruction to send a product for inspection does not constitute approval of the warranty claim.

Final warranty determination may occur only after inspection or manufacturer review.

6. DO NOT CONTINUE USING A SUSPECTED DEFECTIVE PRODUCT

If a customer reasonably believes that a product is defective, damaged, unsafe, or malfunctioning, the customer should discontinue use when continued operation could reasonably cause additional damage or create a safety risk.

Continuing to operate a vehicle or product after becoming aware of a serious malfunction may cause additional damage and may affect warranty coverage depending upon the manufacturer's terms and circumstances.

Customers should seek appropriate professional diagnosis when necessary.

7. INSTALLATION AND DIAGNOSIS

Automotive performance products frequently require specialized installation, calibration, tuning, programming, diagnosis, or supporting modifications.

Customers are responsible for ensuring that products are installed and used appropriately for their intended application.

Where relevant, AGM or the manufacturer may request evidence concerning installation or diagnosis before processing a warranty claim.

The mere fact that a vehicle experiences a problem after installation of a product does not by itself establish that the product is defective.

8. MODIFIED VEHICLES

Many AGM customers purchase products for modified or performance vehicles.

Vehicle modifications may affect product operation, compatibility, reliability, and warranty eligibility.

Manufacturer warranty coverage may depend upon factors including:

  • vehicle configuration;
  • supporting modifications;
  • calibration or tuning;
  • fuel used;
  • boost pressure;
  • operating conditions;
  • installation;
  • maintenance;
  • intended application; and
  • compliance with manufacturer instructions.

Warranty determinations involving modified vehicles will be evaluated according to the applicable manufacturer's warranty terms and the circumstances of the claim.

9. COMMON WARRANTY EXCLUSIONS

Manufacturer warranties vary, but warranty coverage may exclude or limit claims involving circumstances such as:

  • improper installation;
  • incorrect application;
  • misuse;
  • abuse;
  • racing or competition use;
  • operation outside manufacturer specifications;
  • unauthorized modification of the product;
  • improper tuning or calibration;
  • insufficient supporting modifications;
  • improper maintenance;
  • contamination;
  • impact damage;
  • accident damage;
  • overheating;
  • oil starvation;
  • improper lubrication;
  • improper fuel;
  • electrical damage;
  • improper wiring;
  • water intrusion;
  • corrosion;
  • normal wear;
  • consumable components; or
  • damage caused by another failed component.

This list does not create exclusions that are absent from the applicable manufacturer's warranty. The manufacturer's actual warranty terms control manufacturer warranty eligibility.

10. TUNING AND ELECTRONIC PRODUCTS

Warranty claims involving tuners, programmers, controllers, modules, sensors, electronic components, or software may require additional troubleshooting.

The manufacturer may require information such as:

  • serial numbers;
  • VIN information;
  • software versions;
  • firmware versions;
  • diagnostic codes;
  • data logs;
  • screenshots;
  • photographs;
  • configuration information; or
  • evidence of troubleshooting procedures.

Customers should not reset, unlock, unmarry, reprogram, alter, or dispose of a product involved in a pending warranty claim unless instructed to do so.

11. MANUFACTURER INSPECTION

A manufacturer may require a product to be returned for inspection before deciding a warranty claim.

Inspection may determine whether the failure resulted from a covered manufacturing defect or another cause.

AGM does not guarantee the outcome of a manufacturer's inspection.

If the manufacturer determines that the product is not defective or that the claim falls outside warranty coverage, the manufacturer may deny the claim.

12. WARRANTY REMEDIES

If a warranty claim is approved, the available remedy is determined by the applicable warranty and applicable law.

Depending upon the manufacturer and circumstances, a remedy may include:

  • repair;
  • replacement;
  • replacement component;
  • manufacturer credit;
  • refund where applicable; or
  • another remedy provided by the manufacturer.

Submitting a warranty claim does not automatically entitle the customer to a refund.

AGM cannot guarantee that a manufacturer will provide the customer's preferred remedy.

13. ADVANCE REPLACEMENTS

AGM does not guarantee advance replacement of a product while a warranty claim is pending.

If a customer chooses to purchase a replacement product before a warranty determination is completed, that purchase is generally a separate transaction unless AGM expressly agrees otherwise in writing.

Approval of the original warranty claim does not automatically require AGM to refund an independently purchased replacement unless the applicable manufacturer warranty, AGM's written agreement, or applicable law provides otherwise.

14. SHIPPING COSTS

Responsibility for shipping costs associated with a warranty claim depends upon the applicable manufacturer's warranty, the circumstances of the claim, and applicable law.

Customers may initially be responsible for shipping a product for warranty inspection when permitted by the manufacturer's policy and applicable law.

If a manufacturer provides prepaid shipping or reimburses qualifying shipping expenses, AGM will administer the claim consistent with the applicable warranty procedure.

AGM will not impose shipping costs on a customer where doing so would violate applicable law.

15. LABOR AND RELATED COSTS

Unless expressly covered by the applicable manufacturer's warranty, AGM does not promise reimbursement for costs associated with diagnosing, removing, installing, reinstalling, programming, calibrating, tuning, or transporting a product involved in a warranty claim.

This may include:

  • diagnostic labor;
  • installation labor;
  • removal labor;
  • reinstallation labor;
  • towing;
  • vehicle storage;
  • rental vehicles;
  • loss of vehicle use;
  • tuning;
  • programming;
  • fluids;
  • gaskets;
  • fasteners;
  • shop supplies; or
  • other incidental expenses.

If the manufacturer's written warranty expressly provides coverage for a particular expense, the manufacturer's warranty terms will control that claim.

Nothing in this section excludes damages or remedies that cannot legally be excluded.

16. CONSEQUENTIAL VEHICLE DAMAGE

An alleged product failure does not automatically establish that the product caused damage to the vehicle, engine, transmission, drivetrain, electrical system, or another component.

Claims alleging consequential vehicle damage may require inspection, diagnosis, photographs, maintenance information, data logs, installation records, or other evidence.

Any manufacturer responsibility for consequential damage is determined under the manufacturer's warranty and applicable law.

Nothing in this Policy waives liability or remedies that cannot legally be waived.

17. PRODUCTS INSTALLED BY AGM

If AGM installed the product involved in the claim, contact AGM and explain the issue before having another shop remove, modify, repair, or replace the product when reasonably practical.

Products installed by AGM may involve separate workmanship, repair-order, service, or installation terms.

A manufacturer product warranty and any applicable AGM workmanship obligation are separate issues and may be evaluated separately.

18. PRODUCTS INSTALLED BY THIRD PARTIES

AGM is not responsible merely because an independent shop or third party improperly installs, diagnoses, modifies, tunes, removes, or repairs a product purchased from AGM.

However, third-party installation by itself does not eliminate manufacturer warranty coverage unless the applicable warranty and law permit that result.

Customers should retain installation invoices, diagnostic reports, and other records that may be relevant to a warranty claim.

19. VEHICLE MANUFACTURER WARRANTIES

Installing aftermarket products may affect a vehicle manufacturer's warranty in some circumstances.

AGM does not determine or control whether a vehicle manufacturer or dealership will approve a particular vehicle warranty claim.

Customers should review their vehicle warranty and obtain appropriate information before modifying a vehicle if preservation of factory warranty coverage is important to them.

AGM does not represent that purchasing or installing an aftermarket product automatically voids or preserves a vehicle manufacturer's warranty.

20. PRODUCT RECALLS AND SAFETY NOTICES

If AGM becomes aware of a manufacturer recall or safety notice affecting a product purchased from AGM, AGM may take reasonable steps to provide information to affected customers when customer and transaction information is available.

Customers must follow applicable manufacturer recall instructions.

Recall remedies are determined by the manufacturer and applicable law.

21. WARRANTY FRAUD AND ABUSE

AGM may deny AGM-provided warranty assistance, subject to applicable law, where a claim involves materially false information, altered documentation, substituted products, manipulated serial numbers, fraudulent proof of purchase, intentional damage, or other fraudulent conduct.

AGM may provide relevant information to manufacturers, payment providers, insurers, carriers, or law enforcement where reasonably necessary and legally permitted to investigate suspected fraud.

22. RECORDS

Customers should retain:

  • AGM purchase confirmation;
  • invoices;
  • installation records;
  • maintenance records;
  • serial numbers;
  • product packaging where appropriate;
  • diagnostic reports; and
  • other documents relevant to warranty eligibility.

Certain manufacturers may require some of these records before approving a claim.

23. NO GUARANTEE OF MANUFACTURER APPROVAL

AGM may assist customers with legitimate manufacturer warranty claims, but AGM does not control an independent manufacturer's final warranty determination.

AGM's assistance with submitting, documenting, communicating, or processing a manufacturer warranty claim does not constitute a guarantee that the manufacturer will approve the claim.

AGM will not knowingly misrepresent a manufacturer's warranty decision or prevent a customer from exercising rights available under applicable law.

24. RELATIONSHIP TO AGM'S OTHER POLICIES

Standard returns and exchanges are governed by AGM's Refunds, Returns & Exchanges Policy.

Shipping matters are governed by AGM's Shipping & Delivery Policy.

Website purchases and other transactions are also subject to AGM's Terms & Conditions.

If a manufacturer's written warranty provides the customer with additional warranty rights, the applicable manufacturer warranty controls those manufacturer-provided rights.

25. NONWAIVABLE RIGHTS

This Policy is intended to operate to the fullest extent permitted by applicable law.

Nothing in this Policy excludes, limits, disclaims, or waives:

  • an express warranty actually made by AGM;
  • an applicable manufacturer's warranty;
  • a statutory warranty that cannot legally be disclaimed;
  • liability that cannot legally be excluded; or
  • any consumer right or remedy that cannot legally be waived.

If applicable mandatory law conflicts with this Policy, that law controls to the extent of the conflict.

26. CHANGES TO THIS POLICY

AGM may update this Warranty Information & Warranty Claims Policy periodically.

Changes will not retroactively eliminate warranty rights that had already accrued where prohibited by applicable law.

The "Last Updated" date identifies the current version.
